Terms of Service

Please read these Terms of Service carefully before using the Kaziiko platform. These terms constitute a legally binding agreement between you and Kaziiko Digital Services Ltd.

1. Acceptance of Terms

By accessing or using Kaziiko ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Platform. We may update these terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old and a legal resident of Kenya (or have a valid reason to use Kenyan government services) to use this Platform. By registering, you represent that all information you provide is accurate.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorised use of your account. Kaziiko is not liable for losses arising from unauthorised access to your account.

4. Expert Verification

Experts must complete identity verification before listing services. Kaziiko makes reasonable efforts to verify credentials but does not guarantee the accuracy of all expert-provided information. Clients are encouraged to review ratings and reviews before placing orders.

5. Orders and Payments

Clients pay at the time of order placement via M-Pesa. Funds are held in escrow and released to the expert only upon the client's explicit approval or after a dispute resolution process. The Platform charges a 15% service fee on all transactions, deducted from the expert's payout.

6. Escrow and Fund Release

Funds are released to the expert within 24 hours of client approval of delivery. If the client does not respond within 7 days of the expert marking an order as delivered, funds may be automatically released. Auto-release can be paused by opening a dispute before the 7-day window closes.

7. Revisions and Refunds

Clients may request revisions as specified in the service listing. If, after revisions, the work remains unsatisfactory, the client may open a dispute. Refunds are issued at the sole discretion of Kaziiko following investigation. Refunds are returned via M-Pesa.

8. Prohibited Activities

Users may not: (a) share false or misleading information; (b) use the Platform for money laundering or fraud; (c) circumvent the escrow system by transacting off-platform; (d) harass or threaten other users; (e) attempt to access another user's account or data; (f) use automated systems to interact with the Platform without prior written consent; (g) share personal contact details โ€” including phone numbers, email addresses, or social media handles โ€” through any Platform communication channel; (h) solicit or accept payment outside the Platform's M-Pesa escrow system; (i) refer a client or expert to a third-party channel in order to conduct, continue, or conclude any work that originates on the Platform.

8A. Contact Information and Off-Platform Circumvention

To protect all users, Kaziiko operates an automated system that detects and blocks messages containing personal contact details (phone numbers, email addresses, WhatsApp links, social media handles, and similar identifiers). This detection applies to all chat messages and cannot be disabled. Attempting to encode or obfuscate contact information to circumvent detection constitutes a deliberate violation and will be treated as an aggravated offence. Users who request or accept payment outside the Platform's escrow system โ€” regardless of whether the transaction is described as a "tip", "deposit", or any other label โ€” will be subject to immediate permanent suspension and forfeiture of any escrowed funds. Kaziiko may share evidence of off-platform transactions with the relevant Kenyan regulatory bodies where fraud is suspected.

9. Intellectual Property

Upon full payment and client approval, the client owns the deliverables produced for their order unless the listing explicitly states otherwise. Kaziiko and its logos, brand, and platform code remain the exclusive property of Kaziiko Digital Services Ltd.

10. Confidentiality

Experts agree not to share, sell, or misuse any personal documents, ID data, or information provided by clients. Violation of this clause may result in permanent account suspension and legal action.

11. Dispute Resolution

In the event of a dispute, either party may open a dispute via the Platform. Kaziiko will review the evidence submitted by both parties and issue a binding resolution within 5 business days. All disputes are governed by the laws of the Republic of Kenya.

12. Limitation of Liability

To the maximum extent permitted by law, Kaziiko is not liable for indirect, incidental, or consequential damages arising from use of the Platform. Our maximum liability in any claim is limited to the amount paid for the order in dispute.

13. Termination

Kaziiko reserves the right to suspend or terminate any account that violates these Terms, at any time and without notice. Users may close their account at any time by contacting support.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes that cannot be resolved through our internal process shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
