5. Terms & Conditions
  1. The Tenant shall pay the monthly rent on or before the agreed due date. A late payment penalty of KSh 500 per day may be charged for payments received after the due date.
  2. The security deposit shall be held by the Landlord and refunded within the agreed period after the Tenant vacates, less any deductions for unpaid rent or damages beyond normal wear and tear.
  3. The Tenant shall use the premises solely for residential / commercial purposes and shall not sublet or assign the tenancy without written consent from the Landlord.
  4. The Tenant shall not make structural alterations to the premises without prior written consent from the Landlord. Any approved alterations shall remain with the premises on vacation.
  5. The Tenant shall keep the premises clean and in good repair. Minor repairs below KSh 2,000 are the Tenant's responsibility; major structural repairs are the Landlord's responsibility.
  6. The Landlord shall give the Tenant at least 1 month written notice before entering the premises for inspection or repairs, except in emergencies.
  7. Either party may terminate this agreement by giving the other party 1 month written notice, in accordance with the agreed notice period above.
  8. The Tenant shall not engage in any illegal, immoral or nuisance activities on or near the premises.
  9. On vacating, the Tenant shall return the premises in the same condition as received (allowing for fair wear and tear), and hand over all keys and access cards.
  10. Rent increases shall be communicated by the Landlord with at least 2 months' written notice.

⚠️ Note: Kenya's Landlord and Tenant (Shops, Hotels and Catering Establishments) Act Cap. 301 governs commercial tenancies and provides controlled tenancy protections. For residential premises, the Rent Restriction Act Cap. 296 may apply. Disputes can be referred to the Business Premises Rent Tribunal.

Both parties should retain a signed copy of this agreement. The Landlord may also register the tenancy with the relevant county government.
