4. Terms & Conditions
The Vendor warrants that they are the registered legal owner of the land as described above and has full authority to sell.
The Vendor confirms that the property is free from encumbrances, caveats, court orders or any undisclosed liens as of the date of this agreement, unless disclosed in section 2 above.
The Vendor agrees to provide the Purchaser with the original Title Deed and all documents necessary for land transfer at the Lands Registry upon full payment.
The Purchaser shall be responsible for all stamp duty, land transfer fees and advocates' costs associated with the transfer of ownership.
If the Purchaser defaults on the balance payment by the agreed due date, the Vendor reserves the right to forfeit the deposit and offer the property to other buyers, unless otherwise mutually agreed in writing.
If the Vendor is unable to transfer clean title within 60 days of full payment, the Vendor shall refund the full purchase price without penalty.
The Purchaser is advised to conduct an official search at the Lands Registry (or via Ardhisasa) before making final payment.
Physical possession of the land shall be granted to the Purchaser upon full payment of the purchase price.
